Welcome to the Top Tier K9 AI Assistant. This AI Usage Policy ("Policy") governs your access to and use of the Top Tier K9 AI Assistant (the "AI Assistant"). This Policy is a legally binding agreement between you ("User," "you," "your") and Top Tier K9 Business ("Top Tier K9," "we," "us," "our").

By interacting with or using the AI Assistants, you acknowledge that you have read, understood, and agree to be bound by this Policy.
IMPORTANT NOTICE: FOR EDUCATIONAL USE ONLY. NOT A SUBSTITUTE FOR PROFESSIONAL TRAINING OR VETERINARY ADVICE.
The Top Tier K9 AI Assistant provides information based on Jeff Minder's proprietary training methodology. It is intended solely for educational purposes for existing clients who have completed a Top Tier K9 training program. This AI Assistant is NOT a substitute for professional, hands-on dog training, behavioral consultation, or veterinary medical advice.

Dog training is an activity with inherent risks of injury to both humans and animals. You assume full and sole responsibility for the safety and actions of yourself, your dog, and others when applying any information obtained from this AI Assistant. For any serious behavioral issues, such as aggression, or for any medical concerns, you must consult a certified Top Tier K9 trainer or a qualified veterinarian immediately.

1. Description of the AI Assistant and Its Purpose
The AI Assistant is an automated, conversational tool trained exclusively on the proprietary training materials and methodologies of Jeff Minder and Top Tier K9. Its sole purpose is to serve as an educational resource to help reinforce concepts and provide guidance to pet owners who have already been instructed in the Top Tier K9 system.

The AI Assistant is designed to answer questions and troubleshoot common issues within the specific framework of the Top Tier K9 pet training program. It is not a general-purpose AI and does not access information from the internet or any outside sources.

2. User Representations
By using the AI Assistant, you represent and warrant that:

a. You are at least eighteen (18) years of age and have the legal capacity to enter into this agreement.

b. You are a current or former client of Top Tier K9 and have been formally instructed in its training methods.

c. You understand that the AI Assistant's guidance is supplemental to the training you have already received and is not a standalone training program.

3. Intellectual Property Rights
All content, information, text, methodologies, concepts, and responses provided by the AI Assistant are the exclusive intellectual property of Jeff Minder and Top Tier K9. This includes, but is not limited to, the Foundation Dog® system, training scripts, and all proprietary elements of the Top Tier K9 training curriculum.

We grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the information from the AI Assistant strictly for your personal, non-commercial use in training your own pet. This license is contingent on your adherence to this Policy.

4. Acceptable Use and Prohibited Conduct
You agree that you will not, and will not assist or enable others to:

a. Record, copy, screenshot, reproduce, distribute, or publicly display any conversation or content from the AI Assistant.

b. Create derivative works from, reverse-engineer, or attempt to deconstruct the AI Assistant or its underlying methodology.

c. Use the AI Assistant or its content for any commercial purpose, including for the training of clients' dogs, in public demonstrations, or for inclusion in any other product or service.

d. Use the AI Assistant for any illegal purpose or in any manner that violates the rights of a third party.

e. Interact with the AI Assistant to probe for vulnerabilities, attempt to bypass its safety guardrails, or prompt it to violate its system instructions.

Violation of these terms may result in immediate termination of your access and potential legal action for copyright and trademark infringement.

5. Assumption of Risk and Disclaimer of Professional Advice
You hereby acknowledge and agree that your use of the AI Assistant and its content is entirely at your own risk. Dog behavior can be unpredictable, and the application of any training technique can lead to unforeseen outcomes, including but not limited to property damage, bites, or other injury to humans or animals.

You voluntarily assume all risks associated with your use of the AI Assistant. You are solely responsible for evaluating the appropriateness and safety of any guidance for your specific dog and situation. The information provided does not constitute certified professional advice, and no trainer-client, veterinary-patient, or other professional relationship is formed through your use of the AI Assistant.

6. No Guarantees of Results
Top Tier K9 makes no guarantee that the training techniques, methods, or advice provided by the AI Assistant will be safe, appropriate, or effective for your individual dog or circumstances. Training outcomes vary widely based on the dog's temperament, history, environment, and the owner's consistency and skill in application. You acknowledge that results cannot be guaranteed and that you bear full responsibility for any outcomes.

7. When to Seek Professional Help
The AI Assistant is not designed to address serious behavioral issues or medical conditions. You must immediately discontinue use of the AI Assistant and seek professional help in the following situations:

a. Aggression: If your dog exhibits aggression toward people or other animals, including biting, lunging, or threatening behavior.

b. Medical Concerns: If you suspect your dog is experiencing pain, illness, or injury that may be affecting behavior.

c. High-Risk Situations: If your dog's behavior poses a safety risk to children, elderly individuals, or vulnerable persons.

d. Lack of Progress: If you are not seeing improvement or if problems are worsening despite following the guidance provided.

In these cases, contact a certified Top Tier K9 trainer for hands-on evaluation or consult a licensed veterinarian for medical assessment.

8. Disclaimer of Warranties
THE AI ASSISTANT AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TOP TIER K9 DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE AI ASSISTANT WILL BE AVAILABLE, UNINTERRUPTED, ERROR-FREE, OR THAT ITS GUIDANCE WILL PRODUCE ANY SPECIFIC OUTCOME.

9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TOP TIER K9, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR JEFF MINDER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, OR ANY DAMAGES FOR PERSONAL OR BODILY INJURY, EMOTIONAL DISTRESS, OR PROPERTY DAMAGE, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF, OR INABILITY TO USE, THE AI ASSISTANT OR ITS CONTENT.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED ONE HUNDRED DOLLARS ($100.00).

10. Indemnification
You agree to indemnify, defend, and hold harmless Top Tier K9, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

a. Your access to or use of the AI Assistant;

b. Your violation of this Policy;

c. Any injury or damage caused by your dog or your application of training advice from the AI Assistant;

d. Your violation of any rights of another person or entity.

11. Privacy and Data Use
What Information We Collect: When you use the AI Assistant, we may collect the text of your conversations, including any information you voluntarily provide about yourself, your dog, and your training situation.

How We Use Your Information: We use conversation data to operate and improve the AI Assistant, to monitor for misuse or safety issues, and to ensure the quality of responses. We do not sell your personal information to third parties.

Data Security: We implement reasonable security measures to protect your information from unauthorized access, disclosure, or destruction. However, no internet transmission is completely secure, and we cannot guarantee absolute security.

Your Responsibility: Do not share sensitive personal information (such as your full address, financial information, or Social Security number) with the AI Assistant. Provide only the information necessary to receive training guidance.

12. Termination
We reserve the right to suspend or terminate your access to the AI Assistant at any time, for any reason, without notice, including for any violation of this Policy. Upon termination, you must immediately cease all use of the AI Assistant.

13. Changes to This Policy
We may update this Policy from time to time to reflect changes in our practices, technology, or legal requirements. We will post the updated Policy on our website and update the "Last Updated" date at the top of this document. Your continued use of the AI Assistant after any changes constitutes your acceptance of the revised Policy.

14. Governing Law and Dispute Resolution
This Policy shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any dispute arising from this Policy shall be resolved through binding arbitration in Madison County, Florida, in accordance with the rules of the American Arbitration Association. You waive any right to a jury trial or to participate in a class action lawsuit.

15. Severability
If any provision of this Policy is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

16. Entire Agreement
This Policy constitutes the entire agreement between you and Top Tier K9 regarding your use of the AI Assistant and supersedes any prior agreements or understandings, whether written or oral.
